Terms and Conditions

By downloading or using the Headbands: Charades Group Game app, these terms will automatically apply to you. You should make sure that you read them carefully before using the app.

You are not allowed to copy, modify, distribute, sell, or lease any part of the app or its content. You are not allowed to attempt to extract the source code of the app, translate the app into other languages, or create derivative versions of the app. The app itself, and all trademarks, copyright, database rights, and other intellectual property rights related to it, belong to Anil Akgunes.

Headbands: Charades Group Game is a freemium app. The app is free to download and use, with optional in-app purchases and subscriptions for premium features or content. We will always make it clear what you are paying for before any purchase or subscription is completed.

Anil Akgunes is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app, update features, add or remove content, or change premium offerings at any time and for any reason.

Eligibility

The app is intended for a general audience and is designed to be played by families and groups. It does not contain age-restricted content.

If you are under the age of majority in your country, you may use the app only with the involvement of a parent or legal guardian. Purchases and subscriptions must be made by a person legally able to enter into a binding agreement, or by a parent or guardian on that person's behalf.

Subscriptions and In-App Purchases

The app offers optional subscriptions that provide access to premium features and content, including additional word categories, unlimited custom categories, and the optional video recording feature.

Subscriptions are offered on a weekly and an annual basis. The exact duration, price, and any introductory or free trial offer applicable to you are shown in the app before you confirm your purchase, in your local currency. Prices may vary by country and may change over time.

Payments are processed through the App Store and are subject to Apple's payment terms and conditions. I do not process or store your payment card information, bank account information, or other payment details.

Subscriptions automatically renew at the end of each subscription period unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription at any time through your App Store account settings.

If a free trial is offered, it will be clearly presented before you start the trial. Unless canceled at least 24 hours before the trial ends, the subscription will automatically convert to a paid subscription at the price shown at the time of purchase. Any unused portion of a free trial is forfeited if you purchase a subscription during the trial period.

Refund requests and billing issues are handled by Apple in accordance with Apple's policies. Anil Akgunes does not directly manage App Store refunds.

Your Content and Acceptable Use

The app allows you to create your own categories and word lists. This content is stored only on your device, and you remain responsible for it. You agree not to use the app to create, store, or share content that is unlawful, defamatory, hateful, or that infringes the rights of others.

If you submit feedback through the app, you grant me permission to read, store, and use that feedback in order to review the issue and improve the app. Please do not include personal information in your feedback.

Video Recording

The app includes an optional video recording feature that is turned off by default. When you enable it, the app records video from the front camera together with audio from the microphone, and on iOS also records the game screen, in order to create a clip of your game.

Because the app is a group game, a recording may capture the image and voice of other people. You are solely responsible for obtaining the consent of everyone who appears in or is audible in a recording, and for complying with any laws in your country regarding the recording of other people. Do not enable the feature if anyone present has not agreed to be recorded. If a child appears in or is audible in a recording, it is your responsibility to ensure that their parent or guardian has agreed to the recording.

Recordings are created and stored only on your own device and are not uploaded to my servers. If you choose to share a recording, you are solely responsible for that recording and for how you use and distribute it. You can delete your recordings at any time from the Saved Videos screen in the app.

Data and Privacy

The app stores and processes a limited amount of information in order to provide, maintain, analyze, and improve the Service. This may include app usage data, product interaction data, an anonymous app-generated identifier, purchase history and subscription status, your device's country and language settings, operating system version, and app version.

Your use of the app is also subject to our Privacy Policy, available at https://www.playcharades.app/privacy-policy, which explains in detail what information is collected, how it is used, and with whom it is shared.

It is your responsibility to keep your phone and access to the app secure. We recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. Doing so could make your phone vulnerable to malware, viruses, or malicious programs, compromise your phone's security features, and may cause the app to not work properly or at all.

Third-Party Services

The app uses third-party services that declare their own Terms and Conditions and Privacy Policies. You agree to comply with any applicable third-party terms when using the app.

These third-party services may be used to provide app functionality, manage purchases and subscriptions, analyze app usage, receive feedback you submit, diagnose technical issues, and improve the Service.

App Availability and Responsibility

Anil Akgunes cannot always take responsibility for the way you use the app. You need to make sure that your device stays charged. If it runs out of battery and you cannot turn it on to use the Service, Anil Akgunes cannot accept responsibility.

Although we aim to ensure that the app is useful, reliable, and updated, we do not guarantee that the app will always be available, error-free, or compatible with every device or operating system version.

Anil Akgunes accepts no liability for any loss, direct or indirect, that you may experience as a result of using or relying on the app, except where required by applicable law.

Updates and Termination

At some point, we may wish to update the app. The app is currently available on iOS. The requirements for the system, and for any additional systems we may decide to support in the future, may change. You may need to download updates if you want to keep using the app.

Anil Akgunes does not promise that the app will always be updated so that it remains relevant to you or works with the iOS version installed on your device.

We may also stop providing the app or terminate access to it at any time without giving notice of termination to you. Unless we tell you otherwise, upon termination:

  • (a) the rights and licenses granted to you in these terms will end;
  • (b) you must stop using the app; and
  • (c) if needed, you must delete the app from your device.

Additional Terms for Apps Obtained Through the App Store

The following additional terms apply to the app because it is made available through the Apple App Store.

Acknowledgement. These Terms and Conditions are concluded between you and Anil Akgunes only, and not with Apple. Anil Akgunes, not Apple, is solely responsible for the app and its content.

Scope of License. The license granted to you for the app is a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

Maintenance and Support. Anil Akgunes is solely responsible for providing any maintenance and support services for the app, as specified in these terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services for the app.

Warranty. Anil Akgunes is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Anil Akgunes.

Product Claims. Anil Akgunes, and not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of the app, including but not limited to product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

Intellectual Property Rights. In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, Anil Akgunes, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Developer Name and Address. Any questions, complaints, or claims with respect to the app should be directed to Anil Akgunes at [email protected].

Third-Party Beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and Conditions, and upon your acceptance of these terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these terms against you as a third-party beneficiary of these terms.

Changes to These Terms and Conditions

I may update these Terms and Conditions from time to time. You are advised to review this page periodically for any changes. I will notify you of any changes by posting the new Terms and Conditions on this page.
